AI Makeup

These Terms are a contract between you and Aylan Apps (“we”, “us”) governing your use of the AI Makeup mobile app, our backend API, and the related website. By creating an account or installing the app you accept these Terms. If you do not agree, don't use the app.

1. The app, in plain language

AI Makeup is an AI makeup try-on and look-design tool. You take or upload a photo; an AI generates makeup looks, tries designs on your photo, and runs a skin-tone / feature analysis. It is a beauty and inspiration tool — nothing more.

Specifically, AI Makeup:

• is not a medical, dermatological, or diagnostic tool;
• does not tell you whether any cosmetic product is safe for your skin;
• does not guarantee that a real look will match a generated preview;
• does not rate or evaluate other people.

2. Eligibility

• You must be at least 13 years old; if you are under the age of majority where you live, you need a parent or guardian's permission.
• You must have the legal right (or your guardian's consent) to enter into this contract.
• Some features (paid subscriptions, AI generation) may be unavailable in your region.

3. Accounts

• You create an account with a username, email, and password.
• You're responsible for keeping your credentials safe, and for activity on your account.
• Don't create multiple accounts to bypass free-tier limits or fraud-prevention systems.
• We may suspend or terminate accounts that violate these Terms (see §9).

You may delete your account at any time from Me tab → Delete account, or by emailing contact@aylantech.com.

4. What you can upload

Only upload photos that:

• show your own face, or a face you have consent to use;
• are appropriate (no explicit content, no illegal content);
• you own or are licensed to use.

By uploading, you grant us a non-exclusive, worldwide, royalty-free licence strictly limited to running the generation, try-on, or analysis you requested, storing and showing the result back to you, and operating, fixing, and securing our infrastructure.

We do not use your uploads for advertising, public display, or to train external AI models.

5. AI results — what to expect

• Generated looks, try-ons, and analysis are AI approximations, not exact representations.
• Colours, coverage, and finish often look different in real life, depending on your skin, the actual products, application technique, and lighting.
• Two generations of the same request can differ because of model variance.
• Always patch-test and follow the instructions of any real cosmetic product you choose to use.

6. Subscriptions and payments

6.1 Plans

We offer a recurring Premium subscription. Current prices and billing period are shown in the app. Free users get a limited allowance (for example, a set number of generations and try-ons per day, and a small number of saved designs); Premium unlocks higher or unlimited use.

6.2 How it's billed

Purchases are processed by the Apple App Store (iOS) or Google Play Store (Android), which handle billing, refunds, and renewals. We manage entitlements through RevenueCat. Subscriptions auto-renew at the end of each period unless you cancel at least 24 hours before it ends; your account is charged for renewal within 24 hours of the period ending.

6.3 Free trial

If a plan includes a free trial and you don't cancel before it ends, it automatically converts and you are charged the full subscription price. Any unused portion of a free trial is forfeited when you purchase a subscription.

6.4 Cancellation

• iOS: Settings → Apple ID → Subscriptions.
• Android: Play Store → Subscriptions.
• We don't run our own billing, so we can't cancel for you.

6.5 Refunds

Refunds are governed by Apple's / Google's policies. Per store rules, we do not provide refunds for the unused portion of a current billing period. Repeated refund abuse may result in account closure (see §9).

7. Content + intellectual property

• Aylan Apps owns the app, the brand, the design, the source code, the AI prompts, and everything we wrote. Don't copy, reverse-engineer, scrape, or resell any of it.
• You own the photos you upload. We get the limited licence in §4 — nothing more.
• AI-generated looks we hand back to you are yours to use personally (save, share with friends or a makeup artist). Don't use them to deceive others or pass them off as real photographs.

8. Acceptable use

You agree not to:

• use the app to harass, defame, shame, or impersonate anyone;
• generate images from photos of people who haven't consented;
• upload explicit content or content involving minors inappropriately;
• attempt to break, probe, or overload our backend;
• circumvent free-tier limits or fraud-prevention checks (e.g. by creating many accounts, faking device IDs);
• use the app for any illegal purpose.

9. Suspension and termination

We may suspend or terminate your access if you violate these Terms, if continued service exposes us, you, or other users to legal / safety risk, or to comply with law. We give notice when reasonably possible. If we terminate without cause and you have an active paid subscription, we refund the unused portion (subject to the platform's mechanics). You can terminate at any time by deleting your account.

10. Disclaimers and limitation of liability

To the maximum extent permitted by law:

• The app is provided “as is” and “as available” with no warranties of any kind.
• Looks and analysis are not medical, dermatological, or cosmetic-safety advice and must not be relied on for any health decision.
• We are not liable for any indirect, incidental, special, or consequential damages.
• Our total liability for any direct damages is capped at the greater of US$50 or the amount you paid us in the 12 months preceding the claim.

Some jurisdictions don't allow these limits — they apply only to the extent legally permitted.

12. Changes to these Terms

We may update these Terms. Material changes trigger an in-app notice 14 days before they take effect. Continued use after that date means you accept the new Terms. If you don't, delete your account before the effective date.

13. Governing law and disputes

These Terms are governed by the laws of France. Disputes go to the competent courts of Paris, France, unless mandatory consumer protection law in your country says otherwise. Where required, you may also use your local consumer dispute-resolution or small-claims procedures.
